In 2021, His Royal Highness Prince Pedro of Bourbon-Two Sicilies, Duke of Calabria, in his position as Grand Master of the Sacred Military Constantinian Order of Saint George, applied for recognition in Spain of The Constantinian Order of Saint George Foundation.  The purpose of the Foundation is to assist and support the charitable activities of the Constantinian Order.

The Ministry of Justice of the Kingdom of Spain has now published the resolution of the General Directorate of Legal Security and Public Faith approving the establishment of and recognizing the The Constantinian Order of Saint George Foundation.  The Ministry of Justice published the resolution in the Boletín Oficial del Estado (“Official State Gazette”) of the Spanish State, at BOE-A-2022-7368 (number 107 dated 5 May 2022 at pages 62916 to 62917).

We have examined the application for registration of the Constantinian Order of Saint George Foundation.

Factual background

First. Constitution of the foundation.

The aforementioned foundation was established by Don Pedro of Bourbon-Two Sicilies as the “International Association of the Sacred Military Constantinian Order of Saint George,” according to a document executed before the Madrid notary Doña Rocío Rodríguez Martín on 30 November 2021, with protocol number 4405.

Second. Address and scope of the foundation.

The domicile of the foundation was established at Calle Maldonado No. 63, 28006 in Madrid and its scope of activities extends to the entire territory of the Kingdom of Spain.

Third. Endowment.

The initial endowment is in the amount of thirty thousand euros (€30,000). The endowment is monetary and has been fully deposited, as evidenced by a bank certification.

Said endowment is subject to the principle of subrogation of assets and, in the event of alienation or encumbrance, will require authorization from the Protectorate of Foundations in the terms provided by law.

Fourth. Purposes of the foundation.

To support the welfare, humanitarian, cultural and patrimonial works of the Constantinian Order, as well as to collaborate on programs and developments with said Order and with as many institutions and individuals, natural and corporate, as the board of the foundation deems appropriate at any time.

To assist people and groups threatened by poverty, exclusion, illness or violence anywhere in the world.

Fundamentals of Law

First.

The following are applicable for the completion of the file:

Article 34 of the Spanish Constitution, which recognizes the right of foundations for purposes of general interest.

Law 50/2002, of 26 December 2002, on Foundations.

Royal Decree 1337/2005, of 11 November 2005, which approves the regulation of foundations recognized by the State.

Royal Decree 1611/2007, of 7 December 2007, which approves the Regulations for the Registry of Foundations recognized by the State.

Order PRE/2537/2015, of 26 November 2015, which establishes the entry into operation and the headquarters of the registry of Foundations recognized by the State and other corresponding provisions.

Royal Decree 1066/2015, of 27 November 2015, which modifies Royal Decree 257/2012, of 27 January 2012, which develops the basic organic structure of the Ministry of Education, Culture and Sport and creates the Protectorate of Foundations recognized by the State.

Second.

According to articles 35.1 of the Foundations Law, 43 of the Regulation of Foundations recognized by the State and 31.3 of Royal Decree 1611/2007, of 7 December 2007, which approves the Regulation of the Registry of Foundations recognized by the State, the registration of foundations will require a favorable report from the Protectorate regarding the suitability of the purposes and regarding the adequacy and sufficiency of the endowment, with a favorable report from the Protectorate of Foundations dated 21 January 2022 appearing in the file.

Third.

According to Order PRE/2537/2015, of 26 November 2015, which established the entry into operation and the headquarters of the registry of Foundations recognized by the State, the foundation is registered in this Registry of Foundations.

For all of which, I resolve:

I hereby register the Constantinian Order of Saint George Foundation, and its board of trustees and positions within it, in the Registry of Foundations.
